Providing financial support for individuals with disabilities requires careful planning. Failure to properly plan for the care of the disabled individual could cause that individual to be disqualified from receiving medical benefits through Medicaid as well as making the disabled individual unable to receive financial assistance through Supplemental Security Income (SSI). The method to avoid this calamity is through the use of a Special Needs Trust.

Brendan Fleming has drafted countless Special Needs Trusts which allow a person to provide financial assistance to a disabled individual, including a developmentally disabled individual, while maintaining eligibility for Medicaid and Supplemental Security Income (SSI).

If the disabled individual is not able to make decisions for themselves, the law provides a means for another responsible adult to make decisions for the disabled individual through a Guardianship / Conservatorship. The Guardian / Conservator would then be able to make all decisions for the disabled individual including medical decisions, financial decisions, and deciding on living arrangements.

Brendan Fleming has not only drafted numerous Guardianships / Conservatorships but has also represented developmentally disabled individuals in these types of legal proceedings.
